Terms of Service

Welcome to Photos by B4. By booking a photography session with us, you agree to the following terms and conditions. Please read them carefully.

Services Offered

Photos by B4, operated by Betsy Belote, provides professional photography services in Delaware, Ohio and surrounding areas (within a 50-mile radius), including but not limited to:

• Sports Photography: Dynamic action shots for youth and amateur athletes
• Family Photography: Portrait sessions capturing family moments and milestones
• Senior Portraits: High school senior photography sessions

Specific details about session length, number of photos, outfit changes, and delivery timelines are outlined in each service package and will be confirmed in your session agreement.

Booking and Reservation

To book a session with Photos by B4, you must:

• Contact us via our website contact form, email, or phone
• Agree on a session date, time, and package
• Provide a non-refundable deposit (if required) to secure your session date

Your session is not confirmed until we have received your deposit (if applicable) and sent you a confirmation email or text.

Payment Terms

Payment for photography services is structured as follows:

• Deposit: A non-refundable deposit may be required at the time of booking to hold your session date. Deposit amounts vary by package.
• Balance Due: The remaining balance is due on or before the day of your session, unless otherwise agreed in writing.
• Accepted Payment Methods: We accept cash, Venmo, and Zelle. Checks may be accepted on a case-by-case basis.
• Late Payments: If payment is not received by the agreed-upon date, we reserve the right to withhold delivery of edited photos until payment is made in full.

Cancellation and Rescheduling Policy

Client Cancellations:

• If you need to cancel or reschedule, please notify us at least 48 hours in advance.
• Cancellations made with less than 48 hours’ notice may result in forfeiture of your deposit.
• If you cancel with adequate notice, your deposit may be applied to a future session within 6 months, subject to availability.

Photographer Cancellations:

• In the unlikely event that we must cancel your session (due to illness, emergency, or unforeseen circumstances), we will notify you as soon as possible and offer to reschedule at no additional cost.
• If a mutually agreeable reschedule date cannot be found, your deposit will be refunded in full.

Weather-Related Cancellations:

• For outdoor sessions, if severe weather makes the session unsafe or undesirable, we will work together to reschedule at no additional cost.

Session Conduct

To ensure a successful photography session:

• Please arrive on time. Late arrivals may result in a shortened session.
• Dress appropriately for your chosen session type and location.
• For family sessions, please ensure all participants are cooperative and ready to be photographed.
• For senior portraits, outfit changes should be prepared in advance (number of outfits varies by package).
• Clients are responsible for the behavior of minors during the session. Parents/guardians must remain present for sessions involving minors.

Image Delivery and Timeline

After your session:

• Edited photos are typically delivered within 2–3 weeks via a secure online gallery.
• Rush delivery may be available for an additional fee — please inquire in advance.
• The number of edited photos delivered depends on your chosen package (Bronze, Silver, or Gold).
• We reserve the right to select which images are edited and delivered, ensuring only the highest-quality photos are provided.
• Unedited RAW files are not provided.

Copyright and Usage Rights

Photographer Copyright:

All photographs taken by Photos by B4 / Betsy Belote are copyrighted and remain the intellectual property of the photographer. By booking a session, you acknowledge and agree to these copyright terms.

Client License:

Upon receipt of payment in full, clients receive a non-exclusive, non-transferable license to use the delivered images for personal, non-commercial purposes, including:

• Printing photos for personal use
• Sharing on personal social media accounts (with credit to Photos by B4 appreciated but not required)
• Sending to friends and family

Prohibited Uses:

• Commercial use, resale, or redistribution of images without written permission
• Editing, altering, or removing watermarks from images (for watermarked preview images)
• Claiming ownership or copyright of the photographs

Photographer’s Use:

Photos by B4 reserves the right to use images from your session for:

• Portfolio and website display
• Social media marketing (Instagram, Facebook, TikTok)
• Promotional materials and advertising
• Photography contests and exhibitions

If you prefer your photos not be used for promotional purposes, you must opt out in writing at the time of booking.

Model Release

By booking a session and accepting delivery of photos, you (and any legal guardians of minors photographed) grant Photos by B4 permission to photograph you/your family and use those images as outlined in the Copyright section above, unless you have opted out in writing.

Limitation of Liability

Photos by B4 will make every effort to produce high-quality images. However, we are not liable for:

• Unforeseen technical issues (equipment failure, data loss, etc.) — though we maintain backup systems and insurance
• Unfavorable weather conditions during outdoor sessions (we will reschedule if needed)
• Client dissatisfaction with photo angles, poses, or expressions chosen during the session
• Injuries sustained during the session — clients participate at their own risk

In the unlikely event of a catastrophic failure that prevents delivery of your photos, our total liability shall not exceed the amount you paid for the session.

Prints and Additional Products

Physical prints and other products (canvases, albums, etc.) are available for an additional fee. Pricing is available upon request. Clients are also welcome to print photos themselves using the digital files provided.

Client Responsibilities

As a client, you agree to:

• Provide accurate contact information
• Communicate clearly about your vision and expectations
• Arrive on time and prepared for your session
• Make full payment by the agreed-upon deadline
• Respect the photographer’s copyright and usage terms

Disputes and Resolution

If you have any concerns about your photos or our services, please contact us within 7 days of receiving your images. We will work with you in good faith to resolve any issues.

If a resolution cannot be reached, any disputes shall be governed by the laws of the State of Ohio and resolved in the appropriate courts of Delaware County, Ohio.

Changes to Terms

Photos by B4 reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.
